I know for a fact my new avatar i am trying to set up is small enough.. and it still wont let me post it saying its too big

It needs to be 75 x 75 pixels. It is to big.

The maximum size is 75 x 75. Your pic is 78 x 90.

but i shrunk it to smaller than that ... and it still wouldn't load

it has a jpeg file also...
